Terms of Service

These Terms of Service ("Terms") govern your access to and use of ChatGiZa, including our website, mobile app, and any related features (collectively, the "Service"), operated by WellXAI ("WellXAI", "we", "us", or "our"). By creating an account, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, please don't use the Service.

Who We Are

WellXAI builds ChatGiZa, a conversational AI assistant for chat, image and video generation, web search, and deep research, alongside supporting tools for developers who want to build on it.

Registration and Access

You must be at least 13 years old, or the minimum age required in your country, to use the Service. If you are under 18, you may only use the Service with a parent or legal guardian's permission, and they are responsible for your use of it. You can use ChatGiZa without an account for a limited number of messages; continued or paid use requires signing in with Google (with Apple and Microsoft sign-in planned). You're responsible for keeping your account secure and for all activity under it. Don't share your login, and let us know right away if you suspect unauthorized access.

Using Our Service

You may use ChatGiZa to chat, generate images and video, search the web, and use any other features we make available, subject to these Terms. Don't use the Service to break the law, harm others, or attempt to abuse, overload, or circumvent our usage limits — for example, creating repeated accounts or switching networks to bypass free-message limits. We may apply rate limits, mobile-network restrictions, or other safeguards to keep the Service usable and fair for everyone, and we may suspend or terminate access for accounts that violate these Terms.

Optional Personality Modes (18+)

In Live Vision's Voice Settings, you may optionally switch ChatGiZa's conversational tone to "Romantic" or "Argumentative." These are fictional AI personas — ChatGiZa is not a real person and does not have real feelings for you, and "Argumentative" mode reflects a contrarian conversational style, not ChatGiZa's genuine opinion. Romantic mode may be flirtatious or affectionate in tone but will not produce explicit or sexual content. These modes are restricted to users who confirm they are 18 or older, and default back to the standard mode until you choose otherwise.

User Content

"User Content" means anything you input into the Service (text, images, files, prompts) and anything the Service generates in response. You retain ownership of the input you provide, to the extent you have the rights to it, and you're responsible for making sure it doesn't violate the law or anyone else's rights. We need a license to store, process, and transmit your User Content in order to operate the Service — for example, to send your prompt to our AI providers and return a response to you, or to save your conversation history so you can pick up where you left off. In Settings → Data Controls, you can choose whether your conversations may be used to improve our models, and you can delete your conversations or your account at any time.

AI-Generated Content & Accuracy

ChatGiZa uses AI to generate text, images, and video, and its responses can be incomplete, inaccurate, or unsuitable for a given purpose. Use your own judgment, especially for anything important — medical, legal, financial, or safety-related decisions should not be based on ChatGiZa's output alone. You're responsible for how you use what ChatGiZa produces.

The Service Is Available "As Is"

We're continually adding features, some of which may still be in testing. The Service is provided "as is" and may contain errors or interruptions. Your use of the Service, including any new or experimental feature, is at your own risk.

WellXAI's Intellectual Property Rights

We and our licensors own all rights, title, and interest in the Service itself, including its software, design, and branding. These Terms don't grant you any rights to our trademarks or branding outside of what's allowed by law or our own published guidelines. If you send us feedback or suggestions about the Service, we may use them without any obligation to you.

Privacy and Data Security

Our Privacy Policy explains what data we collect and how we use it — please read it. We take reasonable steps to protect your data, but no service can guarantee absolute security. You use the Service at your own risk in that respect, and you should let us know promptly if you believe your account has been compromised.

Paid Accounts

GiZa Pro and other paid plans are billed through Stripe on a recurring basis, using the payment method you provide. You can cancel anytime from the Upgrade Plan screen; cancellation takes effect at the end of your current billing period, and payments already made are non-refundable except where required by law. If we change subscription pricing, we'll give you reasonable notice before it applies to your next renewal.

Termination, Suspension, Discontinuation

You're free to stop using ChatGiZa and close your account at any time. We may suspend or terminate your access, without notice, if you violate these Terms, if required by law, or if your use of the Service poses a risk to us, other users, or anyone else. We may also modify, suspend, or discontinue all or part of the Service at any time.

Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, WellXAI is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us, if any, in the 12 months before the claim arose.

Indemnity

You agree to defend and indemnify WellXAI against claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms, to the extent permitted by law.

Dispute Resolution

If a dispute arises, please contact us first — most issues can be resolved directly. Nothing in these Terms limits any rights you have under mandatory consumer protection law in your country of residence.

Mobile App Specific Terms

The ChatGiZa Android app is distributed as a direct download and, where available, through app stores. Where you install it via an app store, that store's own terms also apply to your download and use of the app. We may update the app periodically; some updates may be required to keep using the Service.

General Provisions

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, along with our Privacy Policy, make up the entire agreement between you and WellXAI regarding the Service. We may update these Terms from time to time; continued use of the Service after a change means you accept the updated Terms.
